What is Food?
Food means any substance, whether processed, partially processed or unprocessed, which is intended for human consumption and includes primary food to the extent defined in clause (zk), genetically modified or engineered food or food containing such ingredients, infant food, packaged drinking water, alcoholic drink, chewing gum, and any substance, including water used into the food during its manufacture, preparation or treatment but does not include any animal feed, live animals unless they are prepared or processed for placing on the market for human consumption, plants, prior to harvesting, drugs and medicinal products, cosmetics, narcotic or psychotropic substances.

What is Food Business?
Food Business means any undertaking, whether for profit or not and whether public or private, carrying out any of the activities related to any stage of manufacture, processing, packaging, storage, transportation, distribution of food, import and includes food services, catering services, sale of food or food ingredients.

Who is a Food Business Operator?
Food Business Operator in relation to food business means a person by whom the business is carried on or owned and is responsible for ensuring the compliance of this Act, ( FSSA 2006 ).
Food operations include: selling food, re-packaging or re-labelling, preparing, cooking, storage and handling, retailing, whole-selling or distribution for raw food or food items (including in any religious or social gathering on one occasion only).

What is registration, what all need to be registered?
Law makes it mandatory to register each premises where you carry out your food business operation from, that may include, for example, your home, shop, mobile or temporary premises such as stall, vans, khomcha or tents including those setup during the fairs or exhibitions ( including shops, kitchen units, delivery vehicles and other moveable structures ). 

Additionally, if your food business involves making or preparing or handling food that comes from animals, for example meat or dairy products, other than for direct sale to the end customer, your premises may need to be registered or licensed.

I have multiple locations that prepares, sells food. Are they covered under one registration, license?
You need to register, license each premises separately.

What is Food Business Registration?
In simpler context a food business that has a turnover of less than Rs 12 Lac per annum need to be registered. A food business operator is one that;
  • Who manufactures or sells any article of food himself or a petty retailer, hawker, itinerant vendor or temporary stall holder or distributes food including in any religious or social gathering except a caterer;
  • Such food business including small scale or cottage or tiny food businesses with an annual turnover not exceeding Rs 12 lakhs.
What is Food Business Licensing?
In simpler context a food business that has a turnover of greater than Rs 12 Lac per annum need to be licensed. Any person desirous to commence or carry on any food business should make an application for grant of a license by submitting particulars of the food business.

What Food Businesses are exempted from registration or licensing?
None. All Food Business Operators in the country need to be registered, licensed in accordance with the procedures laid down in Food Safety and Standards Act, 2006

What are the law and the body that governs food businesses in India?
Food Safety and Standards Authority of India ( FSSAI ) is a statutory body setup under Food Safety and Standards Act, 2006. FSSAI, Administered under Ministry of Health and Family Welfare, Government of India governs the food businesses in accordance with the procedures laid down in Food Safety and Standards Act, 2006.

What are the penalties if one runs a business without registration, licensing?
A food business operating without registration and license shall be liable to penalty which may extend to 5 lakhs rupees or shall be punishable with imprisonment for a term which may extend to 7 years and also with fine up to 10 lakhs rupees.

For what period or how long a registration application for a food business may be made?
A food business registration may be applied for a duration ranging from one year and Up to Five years.

A food business license may be applied for a duration ranging from one year and Up to Five years.
